The Juvenile Justice System Juvenile justice is the section of law that applies to persons under the age of 18 not capable of receiving sentencing in the adult court system or old enough to be responsible for criminal acts committed in society. In most states the age of criminal culpability is 18 however, the age requirement can be set lower in accordance to certain crimes and statutes set by the state the juvenile lives in. Juvenile law is primarily run by state law and most states enforce a specific juvenile code the system follows. The juvenile justice system primarily focuses on rehabilitation rather than punishment for youthful offenders. Society appears to concentrate that children are more capable of change than adult offenders more capable of knowing right from wrong (â€Å"Cornell University Law School,† n.d.). The statutes creating the juvenile court systems and methods of allocating with juvenile delinquency are run by courts as a suitable extension of state police power to warrant the safety and welfare of children in the system. The doctrine of parens patriae allows the state to promulgate for the safeguard, care, custody, and upkeep of children within its jurisdiction. In 1968 the Juvenile Delinquency Prevention and Control Act was put into effect, and in 1972 it was put into revision as the Juvenile Delinquency Prevention Act. This act set forth to assist states in dealing with juvenile delinquent acts and assist communities to prevent delinquency by providing services to the community and youths in high risk of subduing to criminal activity (â€Å"Cornell University Law School,† n.d.). The Federal Juvenile Delinquency Act describes juvenile delinquency as an act that is a criminal but is set forth by a youth under 18 years of age. It applies rules that state laws must abide by with concern to juvenile court processes and reprimands (â€Å"Cornell University Law School,† n.d.). Comparison of Juvenile and Adult Courts There are major differences in procedure between the juvenile and adult court systems. In the juvenile system the defendant does not receive a jury trial. The juvenile goes before a judge who decides if a law was broken and what the appropriate punishment is for the youthful offender. Bail that is also commonly used in the adult system is normally not given to minors in the juvenile system. For a juvenile to be free before adjudication, he or she must prove, they are not a flight risk or a further danger to society. Juvenile courtrooms, unlike adult courts are also not open to the public or media because of preserving the privacy of minors in the system (â€Å"Just Cause Law Collective,† 2007). Oddly, punishments for juveniles for smaller offenses are sometimes more strict than an adult would face. Probation sentences can be much longer and have many additional terms, such as keeping up grades in school, obeying his or her parents, and abiding by a curfew. Juveniles facing punishment for more serious offenses however do stand a better chance of early release where most adult offenders could face up to life in prison for the same crime. This happens as a result of most juvenile sentences ending once the youth reaches his or her twenties (â€Å"Just Cause Law Collective,† 2007). Constitutional Safeguards Criminal juvenile proceedings are kept private when the criminal is juvenile. Juvenile records are also sealed when the juvenile becomes an adult. Names are on ice from newspapers and news reporters unlike in adult criminal cases. Court cases for juveniles are secure to the public with only people pertinent to the case being allowed into the courtroom to protect the identity of the juvenile. Safeguards for juveniles differ from those of adults because juvenile proceedings are kept private whereas those for adults are open to the public. The identity of an adult is public record and their crimes do not get sealed away after a certain amount of time. While juveniles seem to be safe more than adults there are safeguards in place to protect adults as well, such as double jeopardy, which means a person cannot be in accusation for the same crime twice. If adult and juvenile case procedures were the same many juveniles would have criminal records going into adulthood for minor offenses or even just mistakes in judgment that could affect his or her future. Adults have a better understanding of the laws and what is right and wrong in addition the consequences of their choices than juveniles do. A juvenile waiver is occurs when a judge transfers a juvenile into the adult court system. This method releases the juvenile from any protection the youth would have under the juvenile court system. At this point the child is put through the same court process an adult offender would face. In most states the average age a youth would be set forth into the adult system is 17; however in some cases children as young as 13 have faced adult trials. Normally a waiver into the adult courts is put into effect because of a long history of offenses by the juvenile or if the crime is well thought-out to be serious or severely heinous. In 1997 28 states had already put into exclusion the offense of murder from the juvenile system. This meaning that a youth would be sent directly into the adult system if he or she was facing such a charge. This number is most likely going to increase that has put more emphasis on the debate of juveniles sent into the adult system. According to â€Å"Findlaw† (2012), â€Å"Some states also have a legal provision which allows the prosecutor to file a juvenile case in both juvenile and adult court. This takes place when the offense and the age of the youth meet certain criteria. Prosecutorial transfer does not have to meet the due process requirement. Approximately 15 states currently have this provision† (Juvenile â€Å"Waiver† (Transfer to Adult Court)). The most land marking case guiding juvenile waivers is Breed vs. Jones that took place in 1975. This case set forth the rule that a youth cannot be adjudicated in the juvenile system and waived into the adult system. This protects the youth under the double jeopardy law. Realistically this case appears not to have much impact on the juvenile system because juveniles can go through a waiver hearing similar to a trial except for the outcomes (â€Å"Findlaw,† 2012). Remanding Juveniles to Adult Courts Over the last several decades remanding a youth into the adult court system has grown in popularity. The public and courts have made it very easy to take a child out of the juvenile system and place him or her into the hands of the adult courts. Most members of society see these measures as a form of fear because of the increase in violent crimes that today’s youth are participating in. State legislatures enacted statutes that extended the age and offense reach of judicial waiver, legislative waiver, automatic transfer, and prosecutorial discretion and concurrent jurisdiction policies that in return has paved the road of sending children into the adult system very smooth. Some states have provisions in which a child can be sent to adult courts regardless of the offense (â€Å"Campaign for Youth Justice,† 2010). Studies prove that more than 200,000 youths under the age of 18 face sentencing in adult courts. Despite that there has been a decrease in juvenile crime over the past few years; provisions making it easier to prosecute juveniles in the adult court system keep increasing. In today’s current time it appears the scale-weighs in favor of punishing children instead of rehabilitating them into productive members of society (â€Å"Campaign for Youth Justice,† 2010). The Miranda Warning The Miranda Warning is a police notice set to criminal defendants brought into custody of law enforcement in the United States before they can ask questions in regard to what took place during the crime they are facing charges with. Law enforcement officials can only ask for precise information such as name, date of birth, and address without reading the suspects his or her Miranda warnings. Confessions and other information that an individual provides him or her will not be well thought-out admissible evidence unless the individual is aware of and give up his or her Miranda rights. Threatening or forcible methods of police interrogation were once generally referred to as undergoing the third degree. Today, as defense against any likelihood of police intimidation, society has the Miranda Warning (â€Å"Mirandawarning.org,† 2010). In 1968 the final version for the Miranda Warning was set by California deputy attorney general Doris Maier and district attorney Harold Berliner. Before the establishment of the Miranda Warning, confessions had only to be intentional on the suspect. This made a difficult situation for law enforcement, who often met with evidence at trials that the defendant was not of sound mind or were under indirect pressure when he or she gave his or her confessions. The Miranda Warning protects society’s rights by clarifying his or her choices clearly and supports police power when law enforcement properly reads the Miranda Warning and gets clear, intellectual answers that the suspect understands his or her rights as they have been clear up. Frank Mccourt: Angela’s Ashes

In this hard world where winning is more important than participating you would sometimes almost forget to be generous from time to time. But when I read Angela’s Ashes by Frank McCourt I got a completely different view on generosity and the importance of it. This memoir is about the miserable Irish Catholic childhood of the writer. And I think that after this essay you will see that acts of generosity can make the lives of the poor better and that those people afterwards can also help other poor people. Firstly, it were rough times for the McCourt family.Dad -Malachy- was drinking the dole, the family lived in a bad house and children kept dying. The only way the McCourt’s could keep their heads above water was getting help from others. One thing that helped them in their struggle for survival was the St. Vincent the Paul Society. On page 79 they get help for the first time. I quote â€Å"The man in the middle says he’s giving Mam a docket to get a week’ s groceries at McGrath’s shop on Parnell Street. There will be tea, sugar, flour, milk, butter and a separate docket for a bag of coal from Sutton’s coal yard on the Dock road. In my opinion this is generous because I think that generosity means to help someone without gaining profit from it yourself and the St. Vincent de Paul Society doesn’t get anything back for this. That this gift of the St. Vincent de Paul Society is very helpful for the McCourt’s is confirmed by this â€Å"Mam wipes her face at the back of her sleeve and takes the docket. She tells the men, God bless you for your kindness†(page 79). Even though they get some support from the St. Vincent de Paul Society the McCourt family didn’t have enough to be very happy or to not have hunger.Therefore it is very good that others also helped the family sometimes. Another gift that I found generous was that some shopkeepers also gave food to the family for free. â€Å"A few shopkeep ers give bread, potatoes, tins of beans†¦ † (page 90). This, in my opinion, is very generous because those shops are there to make profit and handing out food isn’t profitable for them at all. It’s however very helpful for the McCourt’s. Further on in the book you can also read that Angela could also get credit at Kathleen O’Connell’s shop. Mam says she can now pay off the few pounds that she owes at Kathleen O’Connell’s shop†¦ † (page 133). Of course you could say this isn’t real generosity because Mam has to pay the money back, but I think it is quite generous to give credit to a family that doesn’t have a steady income. Secondly, when Frank is a little older –at the age when he can start working- you can discover a different kind of generosity. The kind of generosity that is more like giving a fishing rod instead of a fish.The first time when you will encounter this type of generosity is w hen Aunt Aggie buys the new clothes for Frank for his job as a telegram boy. â€Å"She takes me to Roche’s Stores and buys me a shirt, a gansey, a pair of short pants, two pairs of stockings and a pair of summer shoes on sale. She gives me two shillings to have tea and a bun for my birthday. She gets on the bus to go back up O’Connell Street too fat and lazy to walk. Fat and lazy, no son of her own, and still she buys me the clothes for my new job† (page 392).I think this is generosity because he now has a suit in which he of course will make a better impression at his new job and he can start making money of his own. In my interpretation Frank appreciated this gift very much because he even cries from happiness â€Å"I turn towards Arthur’s Quay with the package of new clothes under my arm and I have to stand at the edge of the River Shannon so that the whole world won’t see the tears of a man the day he’s fourteen† (page 392). Then after a while he gets fired because he has to deliver a telegram to Mr.Harrington, but he gets falsely accused for stealing ham and sherry. Because of a generous deed of the parish priest he gets his job back. â€Å"She gets a letter from the parish priest. Take the boy back, says the parish priest. Oh, yes father, indeed, says the post office† (page 416). Then when he delivers a telegram to Mrs. Brigid Finucane she asked Frank if he can write letters to her costumers to give her back the money she had leant them. This job yielded him some extra money, so his trip to America came closer and closer. She says, I’ll give you threepence for every letter you write and another threepence if it brings a payment† (page 418). I think it’s very generous from Mrs. Finucane to give this job because it brings Frank closer to his target, going to America. Because of all these acts of generosity towards the McCourt’s and especially Frank McCourt they aren’t the poorest of the poorest. Because they aren’t you can discover some acts of generosity from Frank himself. One generous gesture by him was that he gave his raisin away. I wanted the raisin for myself but I saw Paddy Clohessy standing in the corner with no shoes and the room was freezing and he was shivering like a dog that had been kicked and I always felt sad over kicked dogs so I walked over and gave Paddy the raisin† (page 148). I think it’s very generous to give your food away to someone that has it even worse than you even if you don’t have much yourself. The quote says that Paddy has no shoes. Without acts of generosity towards Frank he probably wouldn’t have them either, so he would have probably eaten the raisin himself.Something else happens much later in the book and that is that Frank throws Mrs. Finucanes’ ledger in the Shannon. This means that a lot of people don’t have to pay her back. †Aunt Aggie’s name i s in the ledger. She owes nine pounds. It might have the money she spent on my clothes a long time ago but now she’ll never have to pay it because I heave the ledger into the river† In my opinion this is a very clear act of generosity because he helps a lot of poor people with this. This is maybe a bit like Robin Hood even.Finally, now we have had a look at how acts of generosity changes the course of events and of lives I think we can conclude that generosity can really change the life of some people. Wouldn’t the McCourt family have died from starvation without generosity? Would Frank McCourt have ever gone to America without generosity? Would Frank have ever been generous to others without generosity from others? I would answer no on all these questions. I also think that generosity leads to more generosity. I hope you will understand this when you look at the last paragraph, because Frank is generous because others have been generous to him.

Changed for the Better

I watched my mom hobble down the driveway like a drunken zombie, nervously grasping onto my dad’s arms as he assisted her into the car to take her to the hospital. Her legs just simply stopped working. I wondered, â€Å"What’s wrong with mommy? Will she come home again?† The last two times my mom went to the hospital, she came home with a new baby brother. But this time, she would have to stay at the hospital for six days to get her treatment. That week felt like a year. I just wanted my mommy home. Watching someone who had been so strong for me, now look so weak was confusing. In 2001, my mom was shockingly diagnosed with Multiple Sclerosis, MS. After four years of back and forths to the local hospital for week at a time, my mom found a treatment that helps her be the best she can be. A once a month trip to the hospital for a few hours, eliminated most of the pains and gets her back on her feet. Literally. All those years of heartache taught my mom that the little stuff isn’t important. She became a happier person because she was conquering this disease and better yet helping people conquer that disease. My mom was honored the role of being the MS ambassador for New Jersey in 2012, giving her opportunity to shoot a commercial for the Multiple Sclerosis walk, do a radio commercial, and travel around the East Coast giving speeches to other MS patients about her triumphs. She goes into these speeches in high heels, showing women they can get better with time and treatment. Her message is that everyone’s path is going to be different with Multiple Sclerosis, so you need to find a doctor that fits you. People with MS gather to hear her story to try to find a way to help them. â€Å"Your speech has given me hope that one day I will be better.† My mom has become an inspiration to many victims of this disease. She has also inspired me to get involved with the organization and go be a counselor for a camp for children whose parents have MS. My mom could have sat and said why me and let the disease take over her life. But she didn’t. I look up to her and admire her every second of everyday because she taught me to be brave and fight for what I want. My family went through this disease together and I believe we were changed for the better because of it. Many would think my mom getting a disease would shatter our family. It did for a while but it also changed us for the better. Living with a disease taught my mom to enjoy the little things because what matters is that she’s healthy. My mom’s disease inspired me to never let something negative takeover my life. It has been eleven years since her diagnosis and she has adopted a role to educate and inspire others to fight and never give up.

I believe that Eva deserved this certificate because she had controlled her anger. When I was going over the museum, I found a part for the Nazi that has the Nazi flag and picture of Hitler. The presence of the Nazi section implied that Eva did not forget, but forgave the misdeeds that she had faced. I believe the purpose of this Museum is to educate people on how to forgive others and even a sinner. If people did not forgive each other; fight and war will become a part of their life. For those who have strong morals, those morals may be complex and hard to understand to others; for this reason, it is common for characters in a book to be simple and their actions to be taken only at face value. Different countries of the world have different cultures. In light of this, there may be discrepancies in the way we interpret our interaction with the person from another culture. In my three years of living in America, I have had experiences based on the difference between the Korean and American culture – these are in the area of non-verbal communication and appointment culture.However, I have also noticed that the structure of the educational system is similar.
